Terms & Conditions
The terms for using this website and enquiring about Particle Vision.
Last updated: 16 September 2026
About these terms
This website is operated by OHMICO (PTY) LTD, Johannesburg, South Africa. Contact info@ohmico.co.za. These terms govern access to and use of the website. Use the site only if you accept these website terms.
The website provides information about Particle Vision and a way to enquire about it. It does not accept online orders or payments. Sending an enquiry does not, by itself, form a purchase or licence agreement.
Licences & commercial agreements
Particle Vision is supplied under a software licence, not a transfer of ownership of the software or its intellectual property. Licence scope, authorised use, term, fees, activation, renewal, support, updates, hardware requirements and termination are those expressly agreed in the applicable quotation, licence or signed contract.
No licence is granted merely by visiting the site, viewing a screenshot or making an enquiry. The applicable written agreement governs the supply of products and services and takes precedence over conflicting general website descriptions, subject to mandatory law.
Unless expressly agreed in writing, the website does not promise bespoke development, integration, compatibility with a particular installation, continuous support or future features. Roadmap items are plans, not delivery commitments.
Refunds, cancellations & issues
Licence fees are non-refundable, except where the applicable written contract expressly provides otherwise or a refund or other remedy is required by law.
Subject to those exceptions, a change of mind, non-use of the licensed software, or changes to a customer’s equipment, staffing or requirements do not create an entitlement to a refund. Customers should confirm the agreed specifications, compatibility requirements and licence scope before purchasing.
Other refunds, cancellations, returns, service issues, warranties, remedies and disputes are handled according to the applicable contract and mandatory law. Where a contract provides a notice procedure or opportunity to remedy an issue, follow that procedure.
Send requests to info@ohmico.co.za with your invoice or contract reference, relevant licence details and a description of the issue. Do not send passwords or licence secrets through this website.
Nothing in these terms removes any cooling-off right, warranty, refund or remedy that cannot lawfully be excluded under applicable legislation, including the Consumer Protection Act or Electronic Communications and Transactions Act where they apply. No blanket waiver of statutory consumer rights is required.
Acceptable use & intellectual property
You may browse the site and use its information for legitimate evaluation of OHMICO’s products. Do not attempt unauthorised access, introduce harmful code, disrupt availability, impersonate another person, or use the content unlawfully.
OHMICO’s name, branding, product content and software remain the property of OHMICO or their respective rights holders. Except as permitted by law or an applicable licence, do not reproduce, commercially exploit, alter or distribute protected material without permission. Third-party assets remain subject to their own rights and licences.
Product information & availability
Website descriptions are general information, not a site-specific specification or performance guarantee. Measurement results depend on the agreed setup and operating conditions, including calibration, camera position, lighting, material and conveyor conditions.
Screenshots may show demonstrations or simulated data. Estimates, including estimated volume, are not guaranteed measurements or a substitute for appropriate engineering, safety or operational checks.
OHMICO may correct or update website content and suspend website access for maintenance, security or operational reasons. Website updates do not unilaterally change an existing signed contract.
Website warranties & liability
To the extent permitted by law, the website and its general information are provided on an “as available” basis. OHMICO does not promise uninterrupted availability, error-free content or suitability of general website information for a particular application.
To the extent permitted by law, OHMICO excludes liability for indirect or consequential loss, loss of profit, revenue, production, business opportunity or data arising from use of, or inability to use, this website. Product and licence liability, warranties and service commitments are governed by the applicable contract.
These exclusions do not apply to fraud, wilful misconduct, gross negligence, or liability or statutory rights that cannot lawfully be excluded or limited. Nothing here requires a consumer to waive a protection that applicable law makes mandatory.
Privacy & third-party links
Our Privacy Policy explains information handling and cookie preferences. Optional tracking consent is separate from acceptance of these terms.
Links to other websites are provided for convenience or information. Their content, availability and practices are controlled by their operators. A link does not create a warranty or endorsement by OHMICO.
Governing law & changes
South African law governs these website terms, subject to mandatory protections and jurisdiction rules that apply to you. Contact info@ohmico.co.za to raise a concern; this does not restrict access to a court, regulator or other remedy available by law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. We may update website terms prospectively by posting a revised version and date. Existing sales and licence contracts remain governed by their own terms.
